These Terms of Service govern your use of our website and purchases made from Bluebell Tails Studio.

Throughout these Terms, “we”, “us” and “our” refer to Bluebell Tails Studio. “You” and “your” refer to the person accessing our website or purchasing products from us.

By placing an order with Bluebell Tails Studio, you agree to these Terms together with our Returns & Refunds Policy, Shipping & Delivery Policy and Privacy Policy.

These Terms apply to customers worldwide. Nothing in these Terms excludes, restricts or limits any statutory consumer right, guarantee or remedy that cannot lawfully be excluded. Where mandatory consumer law applicable to you provides greater protection than these Terms, that mandatory protection will apply.

1. About Bluebell Tails Studio

Bluebell Tails Studio is an independent online store based in the United Kingdom, offering animal-inspired gifts, clothing, homeware, artwork, memorial products and related items.

Our online store is hosted using Shopify.

Products may be manufactured, printed, packaged and/or dispatched on our behalf by selected third-party production and fulfilment partners.

Your contract for products purchased through our website is with Bluebell Tails Studio, unless expressly stated otherwise.

2. Eligibility & Use of Our Store

By placing an order, you confirm that you have the legal capacity to enter into the purchase or have the permission of a parent, guardian or other person legally authorised to act on your behalf where required.

You must not use our website or services:

• for any unlawful or fraudulent purpose;

• to infringe our rights or the rights of another person;

• to transmit malicious software, viruses or harmful code;

• to interfere with the security or proper operation of our website;

• to attempt to gain unauthorised access to our systems or accounts;

• to scrape, harvest or systematically extract substantial amounts of our website content without permission;

• to impersonate another person or provide deliberately false information; or

• in connection with fraudulent payments, chargeback abuse or other unlawful activity.

We may take reasonable steps to protect Bluebell Tails Studio, our customers and our website where we reasonably suspect fraud, unlawful activity, security threats or misuse.

3. Product Information

We take reasonable care to ensure that product descriptions, photographs, specifications, dimensions and other information are accurate.

However, the appearance of products may vary slightly from images displayed on screen due to factors including:

• monitor and device settings;

• differences in colour reproduction;

• printing and manufacturing processes;

• materials;

• product size;

• print placement; and

• reasonable manufacturing tolerances.

Many Bluebell Tails Studio products are individually printed or produced. Minor variations that are inherent in the relevant production process may therefore occur.

These provisions do not affect your rights where goods are faulty, materially different from their description or otherwise fail to conform to applicable consumer law.

4. Product Availability

All products are subject to availability.

We may change, withdraw or discontinue products, designs, colours, sizes or other options offered on our website.

If a product becomes unavailable after you place an order and we cannot reasonably fulfil it, we will contact you and provide an appropriate alternative where you agree to one or refund the affected item where required.

5. Prices

Prices are displayed in the currency shown on our website or selected for your market.

Shipping charges and other applicable costs will be displayed or calculated during checkout where applicable.

International purchases may be subject to customs duties, import taxes or other charges. Please see our Shipping & Delivery Policy for further information.

We may change our prices at any time. A price change will not retrospectively alter the price of an order we have already accepted, except where an obvious error has occurred and applicable law permits us to correct it.

6. Obvious Pricing, Description & Technical Errors

We take reasonable care to keep our website accurate, but errors may occasionally occur.

If a product has been listed with an obviously incorrect price, description, discount, specification or other material information as a result of human error, technical error or system malfunction, we reserve the right to correct the error.

Where an error is identified before an affected order has been fulfilled, we may contact you to explain the error and, where legally permitted, offer you the opportunity to proceed on the corrected basis or cancel the affected order for a full refund.

We will not substitute a materially different product or charge you a higher price without your agreement.

Nothing in this section affects rights that cannot lawfully be excluded.

7. Orders

Submitting an order constitutes an offer to purchase the products in your basket.

You are responsible for checking the information provided before submitting your order, including:

• products;

• quantities;

• colours;

• sizes;

• personalisation;

• billing details; and

• delivery details.

An automated acknowledgement or confirmation that we have received your order does not prevent us from contacting you where there is a genuine issue with the order, such as suspected fraud, an obvious pricing error, product unavailability or an inability to deliver to the supplied destination.

We reserve the right to refuse or cancel an order where we have a legitimate reason to do so, including:

• suspected fraud or unlawful activity;

• inability to authorise payment;

• an obvious pricing or listing error;

• product unavailability;

• an inability to fulfil or legally deliver the product;

• misuse of promotional offers;

• quantities that reasonably indicate unauthorised commercial resale; or

• abusive or threatening conduct connected with the transaction.

Where we cancel an order after payment has been taken and you are entitled to reimbursement, we will refund the affected amount.

We will not exercise these rights arbitrarily or in a manner that unlawfully interferes with your consumer rights.

8. Payment

Payment must be made using a payment method available at checkout.

By submitting payment information, you confirm that you are authorised to use that payment method.

Payments may be processed by third-party payment providers.

If a payment is declined, reversed or identified as potentially fraudulent, we may delay or decline fulfilment while the issue is investigated.

Nothing in this section prevents a customer from exercising a legitimate right to dispute a payment.

9. Promotions & Discount Codes

Promotional offers and discount codes may be subject to additional conditions stated at the time of the promotion.

Unless otherwise stated:

• promotions cannot be combined;

• discount codes have no cash value;

• discounts apply only to eligible products;

• discounts cannot normally be applied retrospectively to completed orders; and

• promotional offers may end when the stated promotional period expires.

We may refuse or cancel the use of a promotion where there is evidence of fraud, manipulation, technical exploitation or use contrary to the clearly stated conditions of the promotion.

This does not affect orders or rights where doing so would be unlawful.

10. Made-to-Order Products

Many Bluebell Tails Studio products are made or printed after an order is placed.

Production time is separate from delivery time.

The fact that an ordinary product is produced after ordering does not automatically make it a personalised product for consumer cancellation purposes.

11. Personalised & Bespoke Products

Some products may be personalised or created specifically to your requirements.

This may include products incorporating:

• a pet's photograph;

• a pet's name;

• names or initials;

• dates;

• personalised wording; or

• other customer-requested details.

You are responsible for checking the spelling, dates, photographs, wording and other personalisation information you provide.

We are not responsible for an error appearing in a personalised product where the product has been produced accurately using incorrect information supplied or expressly approved by you, except where applicable law provides otherwise.

If the error was made by Bluebell Tails Studio or our fulfilment provider, your statutory rights remain unaffected.

Where permitted by applicable law, products made to your specifications or clearly personalised may not qualify for change-of-mind cancellation rights once production has begun.

12. Customer-Supplied Photographs, Artwork & Other Material

Where you provide a photograph, image, artwork, wording, logo or other material for use in a product, you confirm that you own the relevant rights or have the necessary permission to provide that material and authorise its use for your order.

You must not knowingly provide material that:

• infringes another person's copyright, trade mark or other intellectual property;

• unlawfully infringes another person's privacy or image rights;

• is fraudulent or unlawful; or

• we could not lawfully reproduce.

You retain ownership of material you provide.

You grant Bluebell Tails Studio and the service providers reasonably necessary to fulfil your order a limited permission to use, reproduce, adapt, crop or otherwise technically process the supplied material only as reasonably necessary to create, process, fulfil and support your order, unless you separately authorise another use.

Where a claim results directly from material supplied by you that you did not have the right to provide or authorise, responsibility will be determined in accordance with applicable law.

13. Artwork Approval

Where we provide a personalised artwork proof for your approval, you are responsible for checking the details shown in that proof carefully.

Once you expressly approve a proof and production begins, we may be unable to make further changes.

Approval does not remove your rights where the final product differs materially from the approved proof, is faulty, or otherwise fails to meet applicable legal requirements.

14. Shipping & Delivery

Production, fulfilment and delivery times vary according to product, destination, fulfilment location and shipping service.

Delivery dates and timeframes are estimates unless we expressly agree that a particular date is guaranteed.

Orders containing multiple products may be produced and delivered separately.

You are responsible for supplying a complete and accurate delivery address. If you discover an error, you should contact us as soon as possible.

Nothing in these Terms excludes responsibility for delivery where applicable consumer law places that responsibility on Bluebell Tails Studio.

15. Customs & International Orders

International orders may be subject to customs procedures, import duties, taxes, handling fees or similar charges.

Where such amounts have not already been collected at checkout and applicable law places responsibility for them on the recipient, you will be responsible for paying them.

We cannot control or guarantee customs-processing times or charges imposed independently by governmental or customs authorities.

This does not affect responsibility that applicable law places on Bluebell Tails Studio.

16. Returns, Refunds & Cancellations

Returns, refunds, exchanges and cancellation rights are governed by our Returns & Refunds Policy, which forms part of these Terms.

Nothing in these Terms limits any mandatory right to cancel, return goods or obtain a remedy that applies to you.

17. Faulty, Damaged or Incorrect Products

If a product is faulty, damaged, incorrect, not as described or otherwise fails to conform to applicable consumer law, please contact us.

Your rights and the available remedies will be determined by applicable consumer law and our Returns & Refunds Policy.

Nothing in these Terms excludes our legal responsibility for faulty or misdescribed goods.

18. Intellectual Property

Unless expressly stated otherwise, all original artwork, illustrations, designs, graphics, photographs, branding, logos, product designs, written content and other original material created by or for Bluebell Tails Studio are owned by, licensed to or used with permission by Bluebell Tails Studio.

All applicable intellectual property rights are reserved.

Purchasing a Bluebell Tails Studio product gives you ownership of the physical product purchased. It does not transfer copyright or other intellectual property rights in the artwork or design.

Unless you have our prior written permission or applicable law expressly allows it, you must not:

• reproduce our artwork or designs;

• copy or trace our artwork;

• sell reproductions of our work;

• use our artwork on other products;

• upload our artwork to print-on-demand or manufacturing services;

• commercially exploit our artwork;

• remove ownership or copyright notices;

• falsely claim our work as your own; or

• use our branding in a way that suggests an affiliation, endorsement or relationship that does not exist.

Unauthorised commercial reproduction or exploitation of our intellectual property may result in appropriate enforcement action.

19. Product Resale

Unless expressly agreed by us, products sold through our consumer store are intended for personal use, gifting or ordinary lawful resale of the genuine physical item you purchased.

Purchasing a product does not grant permission to reproduce the underlying artwork or manufacture additional products using our designs.

We may refuse unusually large orders where we reasonably believe they are intended for unauthorised commercial reproduction or another unlawful purpose.

20. Reviews & Customer Content

You may submit genuine reviews and feedback about your experience.

Reviews must reflect a genuine experience and must not contain unlawful material, threats, harassment, discriminatory content, another person's private information, spam or material that infringes another person's rights.

We will not remove or suppress a genuine review merely because it is critical or negative.

If you voluntarily submit photographs, testimonials or other material specifically for publication, or separately give us permission to publish them, you grant us permission to use that material for the purpose for which permission was given.

You retain ownership of your original content.

21. Third-Party Services & Fulfilment Partners

We use third-party providers to support aspects of our business, which may include ecommerce hosting, payment processing, production, fulfilment, shipping and technology services.

We are not responsible for the independent operation of third-party websites or services that you choose to access outside our website.

However, using a third party to perform part of our obligations does not remove any responsibility Bluebell Tails Studio has to you under applicable consumer law.

Our website may contain links to websites or resources operated by third parties.

A link does not necessarily constitute our endorsement of the third party or its products, services or content.

We are not responsible for the content, availability, privacy practices or independent actions of third-party websites outside our control.

23. Website Availability & Technical Issues

We take reasonable steps to operate and maintain our website but cannot guarantee that it will always be uninterrupted, error-free or available.

This does not affect an order we have already accepted or any mandatory consumer right.

We will not be responsible for a failure or delay caused solely by events outside our reasonable control where we have taken reasonable steps to minimise the effect of the event.

Such events may include, depending on the circumstances:

• severe weather or natural disasters;

• fire or flood;

• war, terrorism or civil unrest;

• government action or legal restrictions;

• widespread transport disruption;

• postal or carrier disruption;

• customs disruption;

• widespread telecommunications or internet failures;

• major disruption affecting production facilities; or

• other comparable events outside our reasonable control.

Where such an event materially affects an order, we will take reasonable steps to inform you and to fulfil our obligations as soon as reasonably practicable.

This section does not remove any cancellation, refund or other remedy you have under applicable consumer law.

25. Limitation of Responsibility

Bluebell Tails Studio is responsible for losses that applicable law requires us to bear.

We will not be responsible for loss or damage caused by:

• inaccurate information supplied by you where we have reasonably relied upon it;

• misuse of a product contrary to its intended purpose or supplied instructions;

• unauthorised alterations made to a product after delivery;

• your failure to take reasonable steps to prevent or reduce avoidable loss;

• events outside our reasonable control where we were not at fault; or

• independent third-party services or websites that are not acting on our behalf in performing our contract with you.

Where permitted by applicable law, we will not be responsible for purely indirect or consequential losses that were not reasonably foreseeable when the contract was entered into and were not caused by our breach or negligence.

Nothing in these Terms excludes or limits our responsibility for:

• death or personal injury caused by our negligence;

• fraud or fraudulent misrepresentation;

• faulty or misdescribed goods where liability cannot legally be excluded;

• breach of mandatory consumer rights; or

• any other liability that cannot lawfully be excluded or limited.

If you purchase a product wholly or mainly for business purposes, different legal rules may apply to that transaction.

Nothing in this section changes your status as a consumer where applicable law treats you as one.

28. Fraud & Abuse

If you purchase as a consumer outside the United Kingdom, this does not deprive you of mandatory consumer protections that apply to you and cannot lawfully be excluded.

Nothing in this clause prevents you from exercising rights concerning jurisdiction or dispute resolution that mandatory applicable law gives you.

Nothing in this section excludes liability for fraud or prevents you from relying on rights or information that applicable law says cannot be excluded.
